Procedures under Article 76 of the Land Readjustment Act
Article 76 Permit Application Standards
The following construction activities within the area of the Land Readjustment Project conducted by the association require the mayor's permission in accordance with Article 76, Paragraph 1 of the Land Readjustment Act.
- Change of Land Characteristics (Cutting and Filling)
- New construction, expansion, and renovation of buildings and structures (fences, retaining walls, garages, etc.)
- Installation or accumulation of items that are not easy to move (over 5 tons)
In addition, an Opinion Statement from each association will be required for the application.

There are some deficiencies in the Application Form. Please prepare it with reference to the sample description.
Points to Note
Regarding the "Location Number of the Act" in the Article 76 Permission Application Form, please check with each union office when obtaining the "Temporary Land Exchange Certificate" or "Reserved Land Certificate" issued by the union.
If the notation of the "land number of the act" is not unified, it may affect the building confirmation process.
・From April 1, 2022, it is required to present identification documents of the applicant when applying and receiving. In the case of corporations, in addition to identification documents, documents that show affiliation (employee ID, business card, etc.) must also be presented.
In addition, the seal is no longer required in the applicant and agent section of the Article 76 application form.

- Elevation drawing (two or more sides) [scale 1:200 or larger]
- Cross-sectional view (two or more sides) [scale 1:200 or larger]
- Documents showing the basis for the area of the site and buildings
For documents from 6 to 12, the basic principle is to use the documents for building confirmation application.
For inquiries to each union, attach documents 2, 3, and 5 through 12; for permission applications under Article 76, attach documents 1 and 3 through 12.

Note: This document will clarify the relocation or new installation of pipe diameter, pipe material, soil cover, position, etc. The same applies to structures, retaining walls, etc.
For inquiries to each union, attach documents 2, 3, and 5 through 9; for permission applications under Article 76, attach documents 1 and 3 through 9.
Activities that do not require permission
- Repairs and renovations that do not require building confirmation for buildings and designated structures
- Installation of gas, electricity, telephone, water, and sewerage service lines associated with construction work
- Actions agreed upon with the future road manager specified in the business plan for road structures within the road
- In cases where procedures equivalent to Article 76 of the Land Readjustment Act are carried out, such as entering into implementation agreements for urban planning projects other than the relevant project (limited to cases not involving building confirmation)
Among the building activities that do not require building confirmation, procedures will be omitted for those activities recognized as unlikely to obstruct the execution of the business. In addition, the relocation of structures carried out at the request of the executor of the business is not subject to this procedure.
Please note that for actions other than those mentioned above, judgment will be made based on their content, so please consult with the implementer (each union) in advance in such cases.
